Information You Provide to Us And How We Use This Information

Chat Logs of Users

BattleOn EpicDuel creates and retains logs of all chat conversations (both private and public) between users ('Chat Content'), as well as private game play patterns and other activity of users within Company games. Additionally, you acknowledge and grant permission to Company to review, monitor, disclose, censor, delete or otherwise remove Chat Content and other private user activity within Company games for the purpose of preventing breaches of this Agreement and of other Company prohibitions on unlawful or abusive activity. Accordingly, you acknowledge that you have no privacy rights whatsoever in Chat Content or any other content that you create in Company games.

Free Accounts
BattleOn EpicDuel has a large portion of their games available to the users for free. In order to register a character for the free version of the game, the only information that BattleOn EpicDuel collects is the user’s e-mail address if the user is over 13 years of age. The e-mail address is used for the following purposes:

1. To send a confirmation notice to the user of their character registration and password information.
2. Upon the user’s request, to send the user password information when the user has lost or forgotten the password.
3. In response to any question, concerns or problem that the user contacted BattleOn EpicDuel about.
4. To contact the user about any problem with the user’s account or conduct in the game.
5. To send out a newsletter*. Out of respect for your privacy, we provide a way to unsubscribe. Please see the Choice and Opt-out section below.

* BattleOn EpicDuel games are unique in a sense that we design and run numerous special events that keep the game constantly fresh, challenging, fun and interesting for our users. Some of these events coincide with actual real life holidays, such as Valentine’s Day, other events are made up as we go along. We use the newsletter to notify our users of all the current events, changes, improvements, upgrades, new characters, etc. In addition, occasionally we may notify our users of new products and services that BattleOn EpicDuel has designed and made available exclusively to our users. In addition, BattleOn EpicDuel may send promotional items and advertisements from the sponsors, however BattleOn EpicDuel will not divulge your personal information to the sponsor directly.

By registering for BattleOn EpicDuel , you consent to: a) receive periodic email communications from BattleOn EpicDuel concerning your account; and b) receive the above-described email newsletter.

Choice/Opt-Out
If you no longer wish to receive our email newsletter and promotional communications, you may opt-out of receiving them by following the instructions included in any newsletter email message. Subscriber Accounts
A Subscriber Account is a paid membership account that provides our users with additional access and privileges while playing BattleOn EpicDuel . The Subscriber Account requires and uses all of the information listed under the Free Account in the same manner. In addition to the above, however, we will require you to provide the following information:

1. First and last name
2. Address, city, state and zip code
3. Home telephone number

We are copied with this information by PayPal (see Security and Credit Card Use below) and require this information for the sole purpose of verifying your account and payment information.

Artix Affiliate Program
The BattleOn EpicDuel Partner Program is Artix’s affiliate marketing program. The Partner Program is the FIRST EVER such program for a Massively Single Player Role Playing Game (MSPRPG), and it is open to anyone 18 years old or older with an active website. For additional information on the Partner Program, please go to http://www.battleon.com/aq-partner.asp. In order to register for the Partner Program, we will require you to provide the following information:

• Address, city, state, zip code and country

What We WILL DO With Your Personal Information
We use third-party service providers (“Service Providers”), such as a shipping company to fulfill orders, and a credit card processing company to bill you for goods and services. When you sign up with the website, we will provide your personal information (e.g. name, address, phone number and email address) to Service Providers as necessary for such Service Providers to provide their respective services. What Are Cookies?
A cookie is a small text file that is stored on a user's computer for record-keeping purposes. Each cookie can only be accessed by the web site that created the cookie. We use cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while on our site.

BattleOn EpicDuel utilizes a credit card processor to process your payments while on our site. We share your name, email address and credit card information with these third parties to provide the service requested. CHILDRENS’S PRIVACY POLICY
BattleOn EpicDuel encourages parents and legal guardians to spend time online with their children. We urge parents and legal guardians to instruct their children to never give out their personal information online without permission. We also recognize a special need to protect personal information obtained from children. In compliance with Children’s Online Privacy Protection Act ('COPPA'), we have adopted the following policies regarding children under the age of 13 ('Children'):

To create a Free Account, BattleOn EpicDuel does not collect or require for the child to provide any personally identifiable information if the child is known to BattleOn EpicDuel to be under the age of 13.

For Subscriber Accounts, the receipt of payment is considered actual, verifiable consent from the parents to the child’s use of our website and to any information that was divulged as reasonably necessary to process payments, verify and maintain the account.

How can parents access, change or delete personally identifiable information about their children?
Once again, we would like to assure you that we do not keep any information other than what is listed above. However, parents are welcome to contact us about any personally identifiable information about their child by email. If your child's personally identifiable information changes, or if you no longer desire our service, you may correct, update, or delete it by making the change within the 'Account Management' section of the site, or by contacting us at the email address provided below. We will respond to your request to access within 30 days. Parents may request that we discontinue collection and use of their Child's Personal Information and request that we delete it by contacting us at the email address provided below.
